Federal Court Certifies Nationwide Class of Labelstock Purchasers in Antitrust Suit
In re: Pressure Sensitive Labelstock Antitrust Litigation, MDL Docket No. 1556.
On November 19, 2007, Judge Vanaskie of the United States District Court for the Middle District of Pennsylvania certified a class of all self-adhesive labelstock purchasers in the United States who bought labelstock from any of the defendants from January 1, 1996 to July 25, 2003, carving out certain specialty products. WW's client, Pamco Tape & Label, was appointed as one of five class representatives.
Plaintiffs brought suit in 2003 against defendants Avery Dennison Corp., Bemis Company, Inc. and its wholly-owned subsidiary Morgan Adhesives Co., UPM-Kymmene Corp. and its wholly-owned subsidiary Raflatac, Inc. The lawsuit alleges that defendants were engaged in a horizontal conspiracy to fix, raise, maintain, or stabilize prices for self-adhesive labelstock in violation of Section 1 of the Sherman Act, causing class-wide damages that flow from this alleged conspiracy. Certain defendants have moved for dismissal of the Second Amended Class Complaint; the Court will hold a hearing on this motion on December 11, 2007. The parties will now begin conducting merits discovery, as the Court had previously limited discovery to class certification issues only.
