Court Grants Preliminary Approval to Pet Food Settlement

On May 30, 2008, the Honorable Noel L. Hillman, United States District Court Judge for the District of New Jersey, entered an order granting preliminary approval to a proposed class action settlement arising from the largest pet food recall in history. The proposed settlement would resolve claims raised in over 100 class actions filed throughout the United States and in Canada. The lawsuits arose after pet food manufacturer Menu Foods announced and initial recall of numerous brands of pet food products in March 2007. The recall quickly expanded to include products manufactured and sold by many other companies, involving hundreds of pet food brands or recipes. It was discovered after the initial recall announcement that certain of the pet food products contained contaminated wheat gluten or rice protein concentrate, which plaintiffs allege caused the illness or death of pets that consumed the recalled food.
