Representing United Food and Commercial Workers Unions and Employers Midwest Health Benefits Fund and acting as a member of the Executive Committee for Consolidated Indirect Purchaser Actions, Wexler Wallace LLP is leading the charge against Sanofi, Bristol Myers Squibb, and Apotex in an antitrust class action concerning Plavix, a drug used to treat patients at risk of heart attack and stroke. WW is seeking relief for indirect purchasers, including union health funds, for damages incurred as a result of an unlawful agreement whereby Apotex, a major generic pharmaceutical manufacturer, agreed not to market a generic version of Plavix,. This caused third party payors to incur significantly higher costs of reimbursing their members for Plavix. The parties are currently briefing motions to dismiss.
