In re Express Scripts, Inc. PBM Litigation, No. 05-md-01672 (E.D. Mo.)

WW is a member of the Plaintiffs Steering Committee, representing the trustees of United Food and Commercial Workers Unions and Employers Midwest Health Benefits Fund in a case alleging that the pharmacy benefit manager ("PBM") defendants breached their duties to third party payor clients in violation of ERISA. There are several consolidated actions, with WW's work focusing on ERISA health plans. This case has been consolidated in the Eastern District of Missouri. Certain plaintiffs are awaiting a ruling on their motion for class certification. Others are filing their motions in late Spring or early Summer of 2008.
