Sheet Metal Workers National Health Fund v. Amgen, Inc. and Amgen USA, Inc., Case No. 2:07-cv-5295 (D.N.J.). In November 2007 WW filed a complaint against Amgen alleging that it designed and implemented an anti-competitive pricing scheme that caused end-payors to pay more for Red Blood Cell Growth Factor ("RBCGF") drugs. RBCGF drugs are used to treat cancer patients in oncology clinics. The case challenges Amgen's practice of penalizing clinics, in the form of higher prices, for Amgen's monopoly White Blood Cell Growth Factor drugs, if they did not purchase substantial volumes of Amgen's RBCGF drugs. The parties are in the process of briefing Amgen's motion to dismiss. WW is serving as interim co-lead counsel in this case.
