Wexler Wallace LLP is currently representing plaintiffs in a class action lawsuit filed in the United States District Court for the Northern District of Illinois on behalf of a former employee of PNC Bank, Mariseli Gomez. The case — filed by Thomas A. Doyle (who is Of Counsel to Wexler Wallace) and by the law firms of Shedden Law LLC and the Burke Law Offices LLC — is a class action and collective action on behalf of current and former employees of PNC Bank in Illinois who were classified as non-exempt from the overtime laws but who worked overtime for which they were not paid.
The Complaint alleges that PNC Bank had a company-wide pattern or practice of requiring employees to work overtime off-the-clock, including overtime hours worked during meal breaks, and overtime hours worked at off-site promotional events. The Complaint alleges that, despite its written policies to the contrary, PNC Bank did not keep track of all of the overtime hours worked by its employees and did not pay its employees in full for the overtime hours that they worked. The Complaint alleges claims under Illinois law and under the federal Fair Labor Standards Act, and seeks an award of damages in the form of unpaid overtime due.
